Welcome to PhysixAI (“Service,” “we,” “us,” or “our”). PhysixAI is your physics assistant, tutor and teacher, available 24/7. These Terms of Use (“Terms”) govern your access to and use of the PhysixAI website, applications, and related services. By accessing or using the Service, including by sending messages or interacting with the chat interface, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance and Eligibility

By creating an account, logging in, or using the Service in any way, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. You must be at least 13 years of age (or the minimum age in your jurisdiction to consent to use online services) to use the Service. If you are under 18, you represent that a parent or guardian has agreed to these Terms on your behalf. We reserve the right to refuse service or terminate accounts at our discretion.

3. Account Registration and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.

The Service uses artificial intelligence to generate explanations and responses. Such content is for educational and informational purposes only. We do not guarantee that AI-generated content is accurate, complete, or suitable for any particular exam or curriculum. You should verify important information with authoritative sources and use the Service as a study aid, not as a sole basis for academic decisions. We are not liable for any reliance on AI-generated content.

7. Subscriptions, Payments, and Refunds

Some features may require a paid subscription or one-time payment. Payment terms, billing cycles, and pricing are presented at the point of purchase and may be governed by additional terms. You are responsible for any taxes that apply. Refund policies are as stated at purchase or in separate payment/refund terms; we are not obligated to provide refunds except as required by law or as we explicitly state.

8. Intellectual Property

Except for User Content and third-party content, the Service and its content, features, design, and technology (including software, text, graphics, and logos) are owned by us or our licensors and are protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works without our prior written consent. “PhysixAI” and related names and marks are our trademarks; you may not use them without permission.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. USE OF THE SERVICE IS AT YOUR OWN RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE AND OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE OR THESE TERMS. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED US DOLLARS (USD $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN SUCH CASES, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

You agree to indemnify, defend, and hold harmless us and our affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms or any law or the rights of a third party.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive (including disclaimers, limitation of liability, indemnification, and governing law) will survive termination.
